Ancillary Proceedings
Many people own property in Colorado but it isn’t where they reside. If a person dies in another state but has property in Colorado, the personal representative of the estate sometimes needs to file an action in Colorado to allow them to property.
We can help assist if this is needed.
What is the process? Ancillary probate administration is a court process through which the foreign personal representative obtains permission to carry out his or her responsibilities as they concern the decedent’s real estate within Colorado. Ancillary administration affirms the authority of the foreign personal representative that was given to him or her by the court of another state.
Usually, ancillary administration will be requested of the state court in the county of the land in question. If there is real estate in more than one county, ancillary probate will need to be filed in each of those counties.
